Terms of Service

1. Acceptance of Terms

By accessing or using TriedIt DIY ("the Service"), including our website and mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Nunn Holdings, LLC ("we," "us," or "our"), a North Carolina limited liability company.

2. Eligibility

You must be at least 13 years old to use the Service (16 in the EU/EEA). If you are between 13 and 18, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Service, you represent that you meet these requirements.

3. User Accounts

You must create an account to access most features. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your login credentials
• Not share your account or allow others to access it
• Notify us immediately of any unauthorized use

We may suspend or terminate accounts that are inactive for an extended period or that violate these Terms.

4. User Content

You retain ownership of content you create and publish on TriedIt DIY, including projects, reviews, images, and text ("User Content").

By publishing User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, display, reproduce, distribute, modify (for formatting and display purposes), and promote your User Content in connection with the Service, including on third-party platforms for marketing purposes.

This license continues for published projects even after account deletion, unless you specifically request removal of individual content. Unpublished drafts and account data are deleted when you delete your account.

You represent that you own or have the rights to all User Content you publish, and that it does not:

• Infringe any third party's intellectual property or privacy rights
• Contain false, misleading, or defamatory material
• Violate any applicable law or regulation

We reserve the right to remove any User Content that violates these Terms. We will make reasonable efforts to notify the content owner before or after removal, except where removal is required by law or the content poses immediate harm.

If you are a registered creator, the Creator Agreement you accepted when becoming a creator contains additional terms governing your content, including affiliate commissions, indemnification, and content moderation. In the event of a conflict, the Creator Agreement controls for matters specific to creator content.

5. Acceptable Use

You agree not to:

• Post spam, fake reviews, or misleading content
• Harass, bully, or threaten other users
• Impersonate another person or entity
• Scrape, crawl, or collect data from the Service by automated means
• Attempt to circumvent tier limits, access controls, or security measures
• Use the Service to distribute malware or malicious content
• Republish other users' projects or content outside the platform without their permission
• Use the Service for any illegal purpose

Violation of this section may result in immediate account suspension or termination.

6. Subscriptions and Payments

TriedIt DIY offers free and paid (Pro) tiers.

Billing and Auto-Renewal

Pro subscriptions are billed on a recurring basis (monthly or annually) and automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us (or our payment processor) to charge the applicable subscription fee to your payment method on each renewal date.

Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain Pro access through the end of your current billing period. No partial refunds are provided for unused portions of a billing period.

Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing period after the notice.

Web Payments

Web subscriptions are processed by Stripe. Refunds are handled per Stripe's policies.

Mobile Payments

If you subscribe through the Apple App Store or Google Play Store, payment is charged to your App Store or Google Play account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Manage or cancel subscriptions in your device's account settings. Refunds for mobile purchases are handled by Apple or Google per their respective policies. Apple and Google are not parties to these Terms.

7. AI Features

Project Preview and HandyBot are AI-powered features that provide suggestions and visualizations.

Disclaimer

AI-generated content is approximate and provided for informational and visualization purposes only. It should not be relied upon as professional advice for construction, structural modifications, electrical work, plumbing, or any activity requiring licensed expertise. We are not responsible for decisions made based on AI-generated content.

Photos and Data

Photos uploaded for Project Preview are sent to our AI provider for processing and are not stored on our servers after the preview is generated. See our Privacy Policy for details.

AI Output Ownership

You may use AI-generated images (such as Project Preview visualizations) for personal, non-commercial purposes. You may not use AI outputs to develop, train, or improve competing products or AI models.

Usage Limits

AI features are subject to usage limits based on your subscription tier. Current limits are displayed in your account settings.

8. Affiliate Links and Product Recommendations

Projects may contain affiliate links to third-party retailers. When you make a purchase through an affiliate link, TriedIt DIY may earn a commission at no additional cost to you. For full details, see our Affiliate Disclosure.

Creator Commissions

Creators earn a share of affiliate commissions generated from products in their projects, including materials, tools, featured products, and Shop the Look items. Commission rates, payment terms, and payout schedules are defined in the Creator Agreement accepted upon becoming a creator.

Product recommendations and pricing are provided by third-party retailers and may change without notice. Purchases through affiliate links are subject to the retailer's terms, return policies, and warranties. We are not responsible for third-party products, pricing, availability, or fulfillment.

9. Intellectual Property

The Service, including its design, code, branding, and non-user content, is owned by Nunn Holdings, LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our proprietary content without written permission.

10. Copyright Infringement (DMCA)

We respect intellectual property rights. If you believe content on the Service infringes your copyright, send a written notice to our designated agent at support@trieditdiy.com with:

• A description of the copyrighted work
• The URL or location of the infringing content
• Your contact information
• A statement that you have a good faith belief the use is unauthorized
• A statement under penalty of perjury that the information is accurate and you are the rights owner or authorized to act on their behalf
• Your physical or electronic signature

We will respond to valid notices in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).

11. DIY Safety Disclaimer

DIY projects involve inherent risks including but not limited to physical injury, property damage, and exposure to hazardous materials. You assume all risk when undertaking any project found on the Service. Always follow proper safety precautions, wear appropriate protective equipment, and consult a licensed professional for electrical, plumbing, structural, or other specialized work. The Service is not a substitute for professional advice or licensed contractor services.

12. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the greater of (a) the total fees you paid to us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or personal injury, regardless of the theory of liability.

13. Indemnification

You agree to indemnify and hold harmless Nunn Holdings, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third party's rights.

14. Termination

By You

You may delete your account at any time from your Account settings.

By Us

We may suspend or terminate your account immediately if you violate these Terms. We may also terminate your account with 30 days' notice for any reason.

Effect of Termination

Upon termination, your right to use the Service ceases immediately. Published User Content may remain on the platform per Section 4 unless you request its removal. We will delete your account data in accordance with our Privacy Policy.

15. Dispute Resolution and Arbitration

Informal Resolution

Before filing any formal dispute, you agree to contact us at support@trieditdiy.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If we cannot resolve a dispute informally, you and Nunn Holdings, LLC agree to resolve any dispute, claim, or controversy arising from or related to these Terms or the Service through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in North Carolina or, at your election, by phone or video conference.

Class Action Waiver

You and Nunn Holdings, LLC agree that disputes will be resolved only on an individual basis and not in any class, consolidated, or representative action. If a court decides that this class action waiver is unenforceable, the arbitration agreement shall be void in its entirety.

Exceptions

Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Service.

16. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

17. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

18. General

• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nunn Holdings, LLC.
• No Waiver: Our failure to enforce any provision does not waive our right to enforce it later.
